Good documentation is the key to legally disciplining employees ...

It would be nice if all employees came to work on time, performed efficiently and pleasantly, and were thankful for their paychecks. But em??ployers know that employees sometimes fall far short of your hopes, in ways that require you to act.

Before you discipline an employee, ask a few key questions to ensure you?re acting appropriately: Does the punishment fit the crime? Have you already discussed the problem with the employee? Are the facts clear, or is there room for disagreement about what happened? Is the punishment you are considering consistent with what you have done in the past?

It?s all about fairness. After all, most workplace lawsuits stem from employees? perceptions that they got a raw deal.

How to document discipline

How you document a discipline issue can cause problems if an employee files a lawsuit. To protect your organization, follow these guidelines:

Be consistent. Check to see how similar problems have been documented in the past.

Be specific. Example of poor documentation: ?Employee was late three times in the past month.? Better: ?Employee was 30 minutes late on Feb. 5; reason given: traffic. Employee was 45 minutes late on Feb. 9; reason given: overslept. Employee was an hour late on Feb. 23; reason given: car problems.?

Write in a clear, factual manner. Note the policy or procedure that the employee has violated. Date the document.

Avoid emotional content, including personal impressions (?I think ??), labels (?He?s a whiner ??), adjectives (?very unproductive ??) and drawing conclusions about the reasons for the employee?s behavior.

State the consequences if the be??havior continues. Example: ?If the employee is tardy again this month, he will be fired.?

Ask the employee to sign and date the document if it?s going into his or her personnel file. If the employee refuses to sign, note that on the document.

Let employees respond in writing and put the response in their files.

What should you document?

  • Excessive tardiness, unexcused absences.
  • Incompetent job performance. Cite attempts you make to help the employee improve.
  • Failure to comply with policy or with established safety procedures.
  • Physical violence, verbal threats.
  • Complaints of sexual harassment or discrimination. Include details of your follow-up investigation.
  • Proven instances of on-the-job drunkenness or drug use.
  • Positive performance. Ironically, failing to document a positive performance can strengthen an employee?s claims of discrimination. A file of all-bad comments may look like a setup.

Insert Coin: Stabil-i reduces iPhone camera shake, fits in your pocket

Ah, stability, a commodity valued by videographers who want to produce footage that won't make their viewers throw up. Reducing camera shake can be especially tricky when using a smartphone such as the iPhone, whose form factor and light weight make it easier to have the shakes while shooting. Currently, options for reducing camera vibration in iPhone videos include apps like the Dolly Cam and more hardware-oriented solutions such as the Steadicam Smoothee. Our latest Insert Coin candidate, the Stabil-i, happens to use the latter route, serving up a "video stabilization iPhone case" that's still reasonably affordable. According to its creators, the Stabil-i's design is based on concepts found in larger, more expensive camera stabilization systems used in the film industry -- minus 90 percent of the hardware and the expensive bearing system. The result, they say, is a device that does a good job in reducing camera shake while still being compact enough to fit in one's pockets.

(AP) ? Movie Star News amassed a staggering amount of film stills, posters and negatives over the past 73 years ? nearly 3 million, including 1,500 prints of Bettie Page, known as the queen of pin-ups. But last week, the once-lively store in lower Manhattan was lifeless. The classic movie posters that once covered its narrow 2,000-square-foot space were rolled up or covered in cellophane, its bins and racks empty. Everything was packed up in cardboard boxes that lined the floor.

The legendary Manhattan store credited with creating pin-up art had sold its entire inventory to a Las Vegas collectibles company.

The collection, regarded as one of the largest of its kind, is headed for the auction block. It will be sold in a series of sales slated to begin next year. The bulk of the collection covers the years 1939 to 1979; 11,500 movies and 5,000 actors are represented.

"This is the most important photo archive of Hollywood in existence. There are tens of thousands of negatives that have never been reproduced," said Stuart Scheinman, co-owner of Entertainment Collectibles, which bought the collection. "There are images here that have never been seen by the public."

There are 2,000 original prints and negatives of Frank Sinatra and Marlon Brando, 1,000 of Gary Cooper, 400 of Bette Davis, hundreds of movie images of "The Godfather" and "Gone With the Wind."

"This could literally take five to 10 years to go through it all," Scheinman said. He would only say the company purchased the collection for "seven figures." Its true value was anyone's guess, but he believed it easily was worth $150 million.

Movie Star News produced 8-by-10 glossy prints from the negatives, selling each for a few dollars in the store and through the mail. But the Internet has significantly cut down on demand.

"I make references to things when customers come in, and they have no idea what I'm talking about," said Ira Kramer, who took over the business that his mother, Paula, and uncle Irving Klaw, started in 1939. "Today, if you want a picture of a star you can go on the computer and download it. So what do you need me for?"

"The maintenance of the collection has been fastidious ... the way a fine library would maintain material," said Arlan Ettinger, president of Guernsey's and in charge of selling the collection.

As far back as the 1940s, Movie Star News had a mailing list of 100,000 names. World War II soldiers were big customers, buying prints for their lockers, Kramer said.

The entrepreneurial Klaw, who died in 1966, hit on the idea of selling pictures of Hollywood stars while operating a movie bookstore.

"He noticed that kids were tearing out the pictures of the movie stars, so he decided to sell their pictures rather than the books," Kramer said. Klaw started dealing directly with movie studios, RKO, Columbia and others, located in those days along Eleventh Avenue.

"He made arrangements to buy from them whatever they didn't want ... original negatives, original prints of 'Citizen Kane,' 'Three Stooges,'" he said. The studios were more than happy to be rid of the stuff for which they had no room.

Kramer's mother was the one who took the pin-up shots. But it was Klaw who launched that side of the business after a man approached him about making him a set of photographs of skimpily-clad girls posing with whips and ropes, said Kramer.

Page was Klaw's favorite model, and a suitcase of the 7-inch heels she wore in the photos, plus other bondage props, will be included in the auction.

The photos were tame by today's standards. In fact, the models were required to wear two pairs of underwear. But the FBI continuously harassed Klaw and he had to appear before the 1955 Senate Subcommittee on Obscene and Pornographic Materials.

"It was a big headache," Kramer said. Klaw finally decided to burn all the pin-up material ? but Paula Klaw saved a lot of it.

Ahead of the Bell: US Durable Goods

WASHINGTON (AP) ? Businesses have been more cautious this year about spending on long-lasting U.S. manufactured goods, a key reason the economy has stayed weak. A report Thursday could offer some clues if their outlook is changing.

Economists forecast that orders for durable goods rose 0.5 percent in June, according to a survey by FactSet. The Commerce Department will release the report at 8:30 a.m. Eastern time Thursday.

Orders rose 1.3 percent in May to $217.4 billion, after two months of declines. That's 52.5 percent higher than the recession low hit in the spring of 2009. Orders are still 12.1 percent below their peak in December 2007.

Most economists will pay closer attention to orders for so-called core capital goods ? computers, machinery and other goods that signal business investment plans. In May, those orders rose at a solid 2.1 percent pace after two months of declines, a hopeful sign that companies are boosting investment.

Durable goods are items that are expected to last at least three years. Orders can be volatile from month to month.

Manufacturing, which has helped drive growth since the recession ended three years ago, has slowed in recent months, along with the broader economy.

Factory activity shrank in June for the first time in nearly three years, according to a survey by the Institute for Supply Management, a trade group. And the Federal Reserve Bank of Philadelphia said last week that manufacturing in that region contracted in July for the third straight month.

There have been a few positive signs.

A survey from Federal Reserve Bank of New York found that manufacturing expanded in that region this month.

And some large industrial companies reported healthy earnings Wednesday. Heavy equipment maker Caterpillar said its second-quarter profit jumped 67 percent, largely because of strong demand for construction and mining equipment. It expressed confidence that the global economy would improve next year.

Healthy sales of passenger jets pushed up Boeing Co.'s second quarter profits 3 percent, the company said Wednesday, a better showing than many analysts expected. But Ford Motor Co. said its net income fell 57 percent, largely because it lost $404 million in Europe.

Factories kept hiring this spring but at a slower pace. Manufacturers added an average of 10,000 jobs a month in the April-June quarter. That's down from 41,000 a month in the January-March quarter.

Overall hiring has also weakened. Employers have added an average of just 73,000 jobs a month in April and May. That followed average gains of 226,000 a month in the first three months of the year.

With job growth weaker and the unemployment rate still high, consumers have pulled back on spending and businesses appear less confident about the economy. That is likely slowing economic growth.

On Friday, the government will issue its first estimate for economic growth in the April-June period. Economists forecast that will show the economy expanded at only a 1.5 percent annual pace. That's down from 1.9 percent in the first quarter.

The Aussie team's chief says the Brits might just do a better job than the Sydney Olympics in 2000. Nick Green tells Australian reporters Tuesday that in his opinion London 2012 will be "the best Olympics ever." The predominantly Australian media responded with mock shock.

EDINBURGH'S FINEST

Olympic fever hasn't swept through all of Britain ? at least not yet.

Most people in Edinburgh, Scotland, are focused on the upcoming Royal Edinburgh Military Tattoo, an annual festival and demonstration that takes place on the esplanade of Edinburgh Castle. But that doesn't mean there wasn't a cheer inside pubs such as Maggie Dickinson's on Grassmarket on Monday when Edinburgh's own cycling star Sir Chris Hoy ? already Scotland's most successful Olympian ? was chosen to carry the British flag for the Opening Ceremony.

Hoy won his first Olympic gold at the Athens Games, but cemented his legacy in Beijing, where he became the first Brit to win three gold medals in a single Olympics since Henry Taylor in 1908. Hoy was chosen to carry the Union Jack at the Closing Ceremony in 2008, and will now carry it for the Opening Ceremony on Friday after a vote of the 542 members of the British team. Hoy will be trying to defend his gold medals in the keirin and the team sprint when the track cycling program begins.

Just how popular is Hoy in Scotland? The Scottish National Velodrome being built for the 2014 Commonwealth Games in Glasgow will be named in his honor.

EXTRA TROOPS

The British government has just announced it is deploying an extra 1,200 more troops to protect Olympic venues. There's no indication that the step was taken as a result of any specific threat.

British troops stepped in earlier this month after the private security company hired to protect the games failed to hire the number of guards it promised.

FROWN FOR THE CAMERA

Only boring, mean people can be a part of the Olympic Games. That goes for athletes, volunteers, journalists ? everybody.

Don't believe it? Just look at those bulky credentials around everyone's necks.

The International Olympic Committee requires that mug shots have a completely colorless facial expression. They say it's needed for security purposes, but it sure makes us all look miserable ? or worse.

FLAME MYSTERY

So where will the Olympics flame burn? Steel magnate Lakshmi Mittal says the ruby-red sculpture that towers over London's Olympic Stadium is not the cauldron that will hold the ceremonial flame. Mittal had floated the idea, but plans arrived too late for consideration.

The lighting of the cauldron is always a big moment for the Olympics, and organizers usually withhold details to ensure drama. But usually there is some structure ? somewhere ? that hints where the flame will burn.

Suspicion had long fallen on the ArcelorMittal Orbit Tower, but Mittal says the tower is art, not a fire vessel for the games that start Friday.

GAMES ? WHAT GAMES?

AP's Joseph White reports in from Scotland:

Yes, I'm at the Olympics ? but I'm some 400 miles (640 kilometers) from center stage.

Glasgow is hosting some of the soccer matches but the Scottish city doesn't have much of an Olympic vibe. In London, one can hardly walk 20 feet without spotting a special Olympic traffic lane or a billboard or some sort of notice; in Glasgow, there is a lonely sign at the main train station telling fans where to queue to catch the subway to historic Hampden Park, plus some Olympic-themed banners lining the streets.

The action starts with a pair of women's matches Wednesday ? two days before the opening ceremony in London ? and the locals have given away thousands of tickets to schools and other youth so the 52,000-seat stadium won't feel so empty.

The two cities can't even agree on the weather.

London had a beautiful sunny day Monday, while Glasgow was so wet and dreary that the U.S. women's team had to take their team photo in the stadium's VIP seats instead of on the field to stay dry. Tuesday in Glasgow, however, is sunnier.

OLYMPIC VARNISH

Kati Elliott has got a nail for you.

The 20-year-old manicurist can paint 240 different designs ? all versions of national flags ? at the P&G Salon in the Olympic media village. The company has similar salons in the athletes village and in central London at the US Olympic family home, where they cater to athletes' moms.

On a recent day, Kati was sporting designs for Great Britain, Sao Tome and Principe, USA, Myanmar and South Africa, all on one hand. The most complicated design? She thinks it's the U.S. Virgin Islands, which packs an eagle, state colors and a shield all into one nail.

TORCH INTERLUDE

From AP's Fergus Bell, a Londoner:

At 8:47 a.m. the Olympic Torch passed along the route near my house, and I was able to experience the torch relay as it was meant to be experienced. And what is that, precisely?

Hundreds of excited men, women and children lined the residential suburban streets. Next came the huge police presence: I counted at least six police motorcycles before I caught a glimpse of the procession.

One poor woman innocently reversed out of her driveway at the wrong moment and was promptly surrounded. The police were good-natured; with three days left, they've probably seen it all.

Then you see the runner. Well, not quite.

First you have at least three buses representing various Olympic sponsors adorned with toned promotional staff cheering about the runner behind. When members of the crowd do finally catch a glimpse of the runner decked out in the official white torch relay uniform, they rush in, cameras out, as they cheer and shriek.

And then it's over. In moments, it's all gone. The cheers echo down the street as everyone disperses, each carrying a big grin.

RIVER GOLF

Talk about a water trap.

U.S. PGA Tour players Sergio Garcia and Dustin Johnson previewed golf's inclusion at the 2016 Olympics by hitting purple balls toward a floating green on London's River Thames in late evening sunshine.

The tee box was on a barge and the floating green bobbed under the giant Olympic rings on the historic bridge. Using lob wedges, Garcia got three of his five shots on the bright green artificial turf island from around 75 yards while Johnson got two ? or maybe it was three.

The pair struggled to see where those little magenta balls ? the official color of the London Olympics ? landed. Curious Londoners peered over the edge of the bridge in bright evening sunshine to see what was going on. Some waved flags.

Golf will be included at the next Olympics in Rio de Janeiro, returning for the first time since 1904.

Said Garcia just before the stunt on the choppy water: "Courses usually don't move this much, but it's definitely going to be fun."

Low income health insurance? | Family Encyclopedia

One of my friends recently came to US from a different country. She sold whatever she had and came to US with 25000$ . Recently since she was sick she had to go to emergency room for three days. The problem is she did not have any kind of health insurance. Somebody in the hospital told her that she might be eligible for special kind of low income insurance. Her salary is 900$ per month and she get some help from her brother to be able to pay for rent and living costs.
Here is my question: does having 25000$ in the bank account disqualify her for this low income insurance? Do they expect that she pay nearly all these 25000$ for the cost of her visit to emergency room?
She was asked to provide all the documents regarding her bank accounts, rent she pays and documents showing her income. She is living in Bay area.

Not sure, is depend on states rule, i think it might affect but mostly depend in your annual income; if she was smart.
