Gov't opposes full severance pay for military gays (AP)

WASHINGTON ? Two days after repeal of the "don't ask, don't tell" policy against gays serving openly in the military, the Obama administration was in court Thursday opposing a lawsuit seeking full severance pay for those dismissed under the law.

The American Civil Liberties Union is seeking class action status for 142 people who only got half pay after their discharge because of being gay. But the Justice Department asked the U.S. Court of Federal Claims to dismiss the case.

Judge Christine Odell Cook Miller said she probably will let the case continue and questioned why the government wouldn't pay now that the law has changed.

"Your timing is exquisite ? two days after the policy goes into effect eliminating `don't ask, don't tell,' here we are," she said as she took the bench.

"I would consider this to be an unenviable argument to have at this time," she told the government's attorney later.

The case was filed by the ACLU on behalf of former Air Force Staff Sgt. Richard Collins of Clovis, N.M. He was honorably discharged in 2006 after nine years of service when two civilians who worked with him at Cannon Air Force Base reported they saw him kiss his boyfriend in a car about 10 miles from the base. The decorated sergeant was off-duty and not in uniform at the time, according to the lawsuit.

In an interview Thursday, Collins said he and his partner, who are still together, always have been discreet about showing affection in public. "That one time I just happened to lean over and kiss him on the cheek," he recalled. "He said something sweet."

The Air Force paid Collins $12,351 instead of the $25,702 he expected after his discharge.

Separation pay is granted to military personnel who served at least six years but were involuntarily discharged, part of an effort to ease their transition into civilian life. But the Defense Department has a list of conditions that trigger an automatic reduction in that pay, including homosexuality, unsuccessful drug or alcohol treatment or discharge in the interests of national security. That policy went into effect in 1991, two years before "don't ask, don't tell" became law.

The suit argues it is unconstitutional for the Defense Department to unilaterally cut the amount for people discharged for homosexuality.

The administration is not defending the merits of the policy. Instead, Justice Department lawyer L. Misha Preheim argued the defense secretary has sole discretion to decide who gets what separation pay and the court cannot rewrite military regulations.

Miller said she would issue a ruling on the government's motion to dismiss by Oct. 15 after full review of the Justice Department's arguments, but her preliminary decision was to deny the motion. She warned Preheim and a uniformed Air Force attorney also at the defense table that they should be prepared for the case to move forward. She said it's probably appropriate to certify it for class action status, if the government really thinks it's worth it to continue fighting the case.

"I can't believe this is something the military wants to revisit now," she said.

Joshua Block, attorney with the ACLU lesbian gay bisexual and transgender project, said class action would cover 142 people who got half pay for being discharged for homosexuality in the past six years ? the time period covered by the statute of limitations ? for a total payment of $2.1 million. Miller, first appointed by President Ronald Reagan and reappointed by President Bill Clinton, questioned why for that amount of money the government would want to wade back into the "don't ask, don't tell" debate.

Collins, who is 35 and works for his partner's business, said he has talked to recruiters about going back into the military now that the policy has been abolished. But he's leaning against it since he'd have to go back in at his old rank after missing out on promotions in the past few years. And if he did re-enter, he said he'd be wary of openly discussing his relationship.

"Even though `don't ask, don't tell' has been rescinded, I wouldn't go out there and flaunt it," he said. "Even though that policy is gone, you are still going to have discrimination from people."

NEW YORK (Reuters) ? Room service? I'd like to order a treadmill.

Hotel chains are delivering everything from yoga videos to recumbent bicycles to guests who prefer to work out their jet lag, or shape up for that business meeting, in the privacy of their rooms.

"Probably fitness equipment is the biggest request we get from guests," said Vivian A. Deuschl of The Ritz-Carlton Hotel Company. "It's the biggest preoccupation of business travellers besides getting their work done, so we try to make fitness available on any basis they ask for."

In-room fitness options aren't limited to Pilates DVDs and yoga mats, although both are in high demand at most of the company's 78 hotels worldwide, according to Deuschl.

"We do folding treadmills and folding recumbent bikes," she explained. "The only things we can't bring to the rooms are heavy weights."

She said women business travellers are particularly keen on exercising their in-room options.

"Just as a lot of women don't like to sit by themselves in a restaurant, a lot of them don't want to work out in a room full of strangers," she said.

Celebrities also tend to prefer their rooms to fitness facilities open to a curious public.

Gym shoes with hygienic, disposable insoles, gym clothes and 6 a.m. staff-led jogs are among the amenities considered standard at most luxury hotels, Deuschl said.

You can even request a personal trainer if you call ahead.

The Kimpton chain of boutique hotels has provided guests in-room 24-hour yoga channel classes and a basket of yoga gear since 2003, according to president and COO Niki Leondakis.

Pilates and meditation classes followed. Hula hoops and jump ropes can be had for the asking.

Leondakis believes the modern business traveller's focus on wellness coincides with the ageing of the baby boomers.

"Twenty years ago it was wine, dine and work, not about maintaining a healthy lifestyle on the road," she said. "People today are looking at work/life balance in a more integrated way."

She said while yoga draws mainly women, both sexes are drawn to hotel-sponsored group runs and bicycle rentals.

Hoyt Harper, of Sheraton Hotels & Resorts, spearheaded Sheraton Fitness, the chain's $120 million initiative to expand both in-room and gym facilities, after a guest survey revealed increased demand.

"Sixty-two percent of our guests told us they were very interested in staying fit on the road," Harper said.

Sheraton's workout-in-a-bag includes exercise cards, mats, and resistance bands. Harper said the foam rollers, which afford a mini-massage, are among the most popular items.

But he said most guests prefer to use Sheraton's revamped fitness centres.

"Hotel facilities were small and cramped and they weren't well stocked," he said. "Our facility is larger, brighter, fresher," he said.

Deuschl thinks the business traveller's obsession with staying fit on the road reflects the travails of modern travel.

"If you're coming off an 18-hour trip to China, you feel the need to be pampered," she said. "If you're a frequent guest and you ask for a treadmill, after two or three times it will be in your room without having to ask."

New clues to molecular understanding of autism

The first transgenic mouse model of a rare and severe type of autism called Timothy Syndrome is improving the scientific understanding of autism spectrum disorder in general and may help researchers design more targeted interventions and treatments.

The research is described in a paper published last week by scientists at the University at Buffalo and Stanford University in the Proceedings of the National Academy of Sciences.

The transgenic mouse developed at UB exhibits the repetitive physical behaviors, altered social behaviors and impaired communication abilities associated not just with Timothy Syndrome but with autism spectrum disorder in general.

The fact that this mouse exhibited so many behavioral parallels with humans diagnosed with autism was both surprising and encouraging, the researchers say.

"This animal and the syndrome that it is associated with, provides one of the best chances to understand the underlying mechanisms of autism," says Randall L. Rasmusson, PhD, professor of physiology and biophysics in the UB School of Medicine and Biomedical Sciences and co-author on the PNAS paper.

That's because the link between this genetic mutation and Timothy Syndrome (TS) is very strong.

"Most genetic mutations linked with autism increase the chances of having autism by a very small factor," Rasmusson explains. "In contrast, 75-80 percent of people with this Timothy Syndrome mutation have autism spectrum disorder."

The mutation alters a very well-known protein, the voltage-gated L-type calcium channel, causing it to affect how much calcium moves into cells and when.

"The fact that TS arises from such a well-defined alteration in a well-known ion channel gives us the opportunity to study the specifics of this one particular route to autism," he continues. "In understanding the specific, we hope to develop a better understanding of autism in general."

The UB scientists say that this research paves the way toward understanding autism on the molecular level, a critical component that has not yet been sufficiently explored.

"As long as autism is diagnosed by a set of behaviors, it will be an ill-defined condition," explains Rasmusson, who brings to the research a personal understanding of the condition's behavioral aspects, since his son is severely affected by autism spectrum disorder.

"Once we start to determine some definitive biomarkers, possibly, as this research suggests, calcium handling indicators, we will be able to appreciate the differences between how different individuals present with this condition," he says.

That understanding will have implications for treatments, too, because as the researchers point out, while 75 to 80 percent of patients with the mutation were diagnosed with autism, 20 percent did not.

"Once we determine how TS is related to being diagnosed with autism spectrum disorder, we have an opportunity to explore how that 20 percent of individuals manage to override the mutation's effect," says Glenna C.L. Bett, PhD, professor and vice chair of the Department of Gynecology-Obstetrics, professor of physiology and biophysics in the UB medical school and co-author on the PNAS paper. "Those mechanisms are likely to play a key role in developing interventional therapies for autism spectrum disorder."

The research also has the potential to help in modeling and understanding other psychiatric disorders, such as bipolar disorder and substance abuse and dependence.

Bett and Rasmusson were originally conducting research on calcium channels and their effects on heart function when they learned of research published in late 2004 showing that this single mutation in the L-type calcium channel could lead to Timothy Syndrome. At that point, they knew that developing a model of TS would be key to understanding the importance of this calcium channel not just in the heart but in other tissues, especially the brain.

"Cellular calcium activity is a dynamic process that can be modulated by behavior, drugs and the environment," Bett explains. "By understanding the Timothy Syndrome mutation and the consequences of altered calcium handling, we hope to develop a general understanding of the link between calcium and the molecular basis of brain function. Understanding this link will provide new avenues for pharmacological intervention."

Now it seems Arnold Schwarzenegger and Bruce Willis are onboard to reprise their cameos from the first film, with bigger parts this time around. (Expanded Expendables!)
